Yes, there are laws in Virginia regarding the advertising of prescription drugs. The Virginia Code of Regulations § 32VAC10-20-360 requires that all advertising of prescription drugs must be reviewed and approved by the Virginia Board of Pharmacy prior to being published. This includes any and all advertising of prescription drugs, including TV, radio, and print advertisements, telephone solicitations, websites, and any other type of communication. The Board of Pharmacy must confirm the accuracy and appropriateness of the advertisement before it can be published. Additionally, advertisements for prescription drugs must include the following information: the name and address of the pharmacy or wholesaler, the name and strength of the drug, the price of the drug, the quantity of the drug, and the precautionary measures regarding its use. Furthermore, a warning must accompany each advertisement that the drug is available only by prescription. Finally, all advertising must be professional and must not contain false or misleading information.
