What is the California Consumer Privacy Act (CCPA)?
The California Consumer Privacy Act (CCPA) is a law that was passed in 2018 and is aimed at strengthening the privacy rights of consumers in California. The law applies to for-profit businesses with annual gross revenues of over $25 million, businesses that receive or share personal information of more than 50,000 people, and businesses that make more than half of their revenue from selling personal information. Under the CCPA, consumers in California have the right to know what data are being collected from them, to see that data, to opt-out of the sale of their data, to delete their data, and, if they become victims of data breaches, to take legal action against businesses that failed to protect their personal information. The law applies to data collected online as well as in person. Businesses are required to post a notice of their privacy policy, be transparent about data collection practices, and comply with consumer requests for personal data. They must also create a system which allows customers to opt-out of the sale of their data. In addition, businesses must provide consumers with the option to delete their data, and must refrain from discriminating against customers who choose to exercise their rights under the law. The CCPA is designed to ensure that businesses are handling consumer data in a secure and responsible manner. Though the CCPA is only applicable in California, other states have already begun to follow suit with similar legislation. In 2020, Georgia passed its own version of the CCPA, the Georgia Personal Data Security Act, which provides similar consumer protections.
