What data is protected under PIPEDA?
Personal Information Protection and Electronic Documents Act (PIPEDA) is a federal privacy law in Canada that governs how companies collect, use, and disclose personal information. Under the law, personal information is broadly defined as “information about an identifiable individual,” including name, age, address, ID numbers, income, opinions, and any other information that can be associated with a person. In Maryland, PIPEDA requires companies to obtain consent from individuals before collecting any of their personal information. Companies must also let individuals know what information they are collecting, how it is being used, and who it is being shared with. PIPEDA also requires companies to take reasonable measures to protect personal information from unauthorized access, use, or disclosure. If a company collects, uses, or discloses personal information without consent or in a manner that is not compliant with PIPEDA, they may find themselves in violation of the law and face legal consequences. Individuals whose data has been mishandled may also sue the company for damages and/or seek injunctive relief. In short, PIPEDA protects most types of personal information, including contact information, health information, financial information, and demographic information. The law also requires that companies must be transparent about how they are collecting and using personal information. If companies in Maryland fail to comply with PIPEDA, they may face civil or criminal penalties.
