How do I evict a tenant?

In Virginia, the process of evicting a tenant is known as an Unlawful Detainer, which is a legal term used when a landowner wants to take possession of a property from which a tenant has not voluntarily vacated. Depending on the exact situation, the length of the eviction process can vary, but generally it can take anywhere from 2-4 weeks to complete. The first step in the eviction process is to issue a formal written Notice to Vacate. This is a document served to the tenant that informs them that they must vacate the premises by a certain date. The notice should include the date by which the tenant must vacate, the reason why they must vacate, and the threat of legal action if they do not leave. If the tenant does not vacate by the date specified in the Notice to Vacate, the landowner is then required to file a Complaint in General District Court. This Complaint will include the tenant’s name, the address of the property, and the reason why the tenant is being evicted. During the hearing, the landowner may present evidence that shows why the tenant should be evicted. If the landowner is able to prove their case, the court will issue an Order of Possession. This Order will require the tenant to vacate the premises within a certain timeframe, and the tenant will be responsible for any outstanding rent or fees. If the tenant does not comply with the Order of Possession, the landowner can then seek a Writ of Possession to take possession of the property. Evicting a tenant can be a difficult process, so it is best to consult with a qualified attorney in order to ensure that the process is done legally.
