The legal issues related to reproductive health and rights in developing countries are complex and often result from prevailing cultural and religious norms. Reproductive health and rights are largely determined by the laws of any given country and vary widely from place to place. In many developing countries, women’s rights are often subordinate to those of men, leaving them with little or no access to health services and contraception, or even the right to refuse to have intercourse. In addition, many of these countries have criminal laws which severely restrict access to abortion, even when a mother’s life is in danger, and there is a lack of legal protection for pregnant women who are victims of violence, including rape, trafficking and other forms of abuse. In the face of these issues, some countries are beginning to address the complexities of reproductive health and rights in various ways. These include measures to increase access to sexual and reproductive health services, including contraception; legal reforms to ensure women’s right to choose and access abortion services; and the inclusion of reproductive health and rights as part of a broader national development agenda. However, much more needs to be done to ensure these rights and services are protected and accessible to all.
