What are the legal rights of biological parents in the United States?

In the United States, biological parents have many legal rights in regards to their children. Depending on the state, a biological parent has the right to visitation, custody of the child, and other legal parental rights. In Virginia, the law states that any unmarried biological parents must sign an Acknowledgment of Paternity before the father can have any legal parental rights. This means that the father must sign a document, usually in court, that declares him as the legal father before he can obtain any legal rights. If the parents were married when the child was born, then both parents are automatically given parental rights. These rights are equal and both parents are given equal custody rights as well as equal visitation rights. In some cases, a parent with custody may try to terminate the other parent’s rights and rights of visitation, such as if a child’s safety is at risk or if the parent is deemed to be unfit. In this case, the parent looking to terminate the other’s custody rights must present evidence to the court to prove the parent is unfit. Overall, biological parents in the United States have many legal rights, but the law varies by state. In Virginia, unmarried biological parents must sign an Acknowledgment of Paternity to obtain legal rights, and married biological parents are automatically granted rights.
