What is the legal status of preimplantation genetic diagnosis in the United States?

Preimplantation genetic diagnosis (PGD) is a procedure utilized to diagnose genetic abnormalities in a human embryo prior to implantation into the uterus. PGD is regulated differently in each state in the United States. In Virginia, it is legal to perform PGD for medical purposes under certain regulations. In Virginia, PGD is regulated under the “Virginia In Vitro Fertilization Act (VIVFA)”. This Act states that any licensed medical doctor can perform PGD only for medical purposes. This means that the doctor must have reasonable scientific evidence that the PGD procedure will be of medical benefit to the prospective parents. The Act also states that the use of PGD for sex selection or to select certain physical traits is strictly prohibited. Furthermore, the use of PGD to identify embryos that are not at risk for serious medical conditions is not legally allowed. In addition, the Virginia VIVFA requires that all PGD testing must be performed in a laboratory that is certified by the state’s Department of Health, and that all results must be evaluated by an independent laboratory. These regulations are in place to ensure that any doctor performing PGD has adequate training in the procedure and that the results are accurate. Overall, PGD is a legal procedure for medical purposes in the state of Virginia. However, certain regulations must be met in order to ensure that the practice is done in a safe and ethical manner.
