Is there a limit on the number of claims I can file in small claims court?
In Virginia, small claims court is a division of the district court with jurisdiction to hear cases involving civil disputes and amount of money up to $5,000. Generally, there is no limit on the number of claims that may be filed in small claims court. However, if the same claimant repeatedly brings claims against the same defendant, the court may consider that person to be a vexatious litigant and may deny the claim. In addition, small claims courts usually limit the number of claims a person can file in a certain time period. For example, a person may only file two claims in a twelve-month period. This prevents a person from filing multiple small claims against the same defendant in order to overwhelm them with paperwork. This type of practice is not allowed by small claims courts. Finally, a person should consider the value of the claim they are filing. If they are filing multiple small claims involving a relatively small amount of money, then it may be more cost effective to combined the claims into one large claim. This prevents a person from having to pay multiple court fees and also reduces the amount of time they need to spend in court. Overall, small claims court can be a great way to settle civil disputes. However, it is important to understand the rules that govern small claims court to ensure that your claims are valid and will receive a fair hearing.
