Is spousal support required to be paid in a lump sum or over a period of time?
In Washington, spousal support is not required to be paid in a one-time lump sum. Generally, spousal support (sometimes referred to as “alimony”) is paid over a period of time in regular payments. These payments may either be specified in the court’s initial order, or may be left up to the two parties to agree upon. The payment schedule is typically based on the financial needs of both parties, as well as their earning potential. The amount of spousal support can be modified if there is a significant change in either party’s financial circumstances. In addition, spousal support may end if either party remarries or if the supported party’s economic circumstances improve. When the court determines the amount and duration of spousal support, it considers certain factors, such as the length of the marriage, the incomes and assets of the parties, their ages and health status, their education levels, and the amount of time it would take for the supported spouse to obtain appropriate employment. In Washington, it is possible to negotiate a lump sum payment of spousal support in lieu of periodic payments. This is sometimes done when one or both of the parties desires a single payment in order to finalize their obligations to one another. However, this must be done in writing and must be approved by the court.
