What is a trust protectorship?

A trust protectorship is an arrangement in which one person, or entity, is legally responsible for the management and protection of the assets within a trust. In Virginia, this arrangement is often referred to as a “fiduciary relationship” and is typically created when an individual sets up a trust to transfer their personal or business assets to their heirs, or beneficiaries, upon their death. The purpose of a trust protectorship is to ensure that the assets are managed properly and any income generated from the trust is used for the benefit of the beneficiaries. The trust protector can also be responsible for ensuring that the terms of the trust are adhered to, and may even be able to make modifications to the trust if necessary. In Virginia, the trust protectorship is a very important part of Trusts and Estates Law. It is designed to protect the assets of the trust from being misused or mishandled while making sure that the trust is managed in the best interests of the beneficiaries. Trust protectorships are usually appointed by the trustor, or creator of the trust, and must be approved by a court. When a trust protectorship is created, the trust protector has a legal duty to act in the best interests of the beneficiaries. This includes providing counsel, offering advice, monitoring the trust’s activity, and investing the trust’s assets appropriately. In some cases, the trust protector may even be able to make decisions regarding distributions from the trust or about how certain assets should be managed.
