What is an Inter-Partes Review and how does it work?

An Inter-Partes Review (IPR) is a type of administrative procedure in Virginia that allows a third party to challenge the validity of a trademark already registered with the Virginia State Office. This process enables a third party to have a trademark they believe to have been improperly granted to the original trademark holder invalidated. To initiate an IPR, the third party must submit a petition outlining the basis for their challenge to the trademark and providing evidence that the trademark is invalid. After this the original trademark holder has the opportunity to respond to the petition, also with evidence. Both sides are then allowed to exchange additional evidence before a decision is rendered. Once the parties have provided their evidence, a panel of judges assigned by the Virginia State Office will review all of the evidence and make a ruling as to the validity of the trademark. If the panel of judges finds that the trademark is invalid, then the trademark in question will be invalidated. IPRs provide an efficient and cost-effective way for third parties to challenge the validity of an existing trademark without having to go through the time and expense of a full court proceeding. Ultimately, this process ensures that trademarks in Virginia are granted and enforced in a fair and just manner.
