What is a trade secret misappropriation claim?

In Virginia, a trade secret misappropriation claim is a legal argument asserting that someone has either stolen or improperly used a trade secret belonging to another person or company. In general, a trade secret claim involves a dispute over intellectual property, such as a formula, pattern, design, or process that gives the person or company an economic advantage over their competitors. In Virginia, a trade secret misappropriation claim is brought under the Uniform Trade Secrets Act (UTSA). To establish a misappropriation under this Act, a plaintiff must show that it possesses a trade secret, that the defendant had access to the secret, and that the defendant improperly acquired, used, or disclosed the secret. Under the UTSA, a trade secret can include anything from customer lists to formulas to processes. If the plaintiff can demonstrate to the court that the defendant misappropriated their trade secret, they may be awarded damages, including payment of the plaintiff’s attorney fees. Additionally, the court may issue an injunction preventing the defendant from using the trade secret. It is important to note that a trade secret misappropriation claim is a particularly high burden for a plaintiff to meet. The plaintiff must be able to show not only the defendant’s improper acquisition, use or disclosure of the trade secret, but that the secret truly gives the plaintiff an economic advantage over its competitors. This is why it is important to take the necessary steps to protect your intellectual property prior to any dispute.
