What types of traffic offenses require a court appearance?
In Virginia, traffic offenses that require a court appearance are more serious violations of traffic law. These violations include Driving Under the Influence (DUI); driving on a Suspended, Revoked, or Canceled License; reckless driving; hit-and-run accidents; and fleeing a law enforcement officer. Each of these carries potential criminal penalties, including fines, jail time, and license suspension or revocation. Additionally, a court appearance may be required for certain violations that may not be considered criminal. These offenses include driving over the posted speed limit by more than 20 miles per hour, racing on the highway, passing a stopped school bus, or failing to yield the right of way to an emergency vehicle. Finally, in Virginia, if you receive a traffic citation that requires a court hearing and you do not show up for the court date, a failure to appear or FTA will be noted and the court could issue a warrant for your arrest. A court appearance is also required if you choose to dispute a traffic ticket or appeal the judge’s decision.
