What types of activities can constitute unfair competition?
Unfair competition in Virginia is regulated by the Federal Trade Commission and the Virginia Unfair Trade Practices and Consumer Protection Act. Unfair competition occurs when a business, individual or other entity uses unfair or deceptive activities to gain an advantage over their competitors in the marketplace. One type of activity that can constitute unfair competition is false advertising. This occurs when a company misrepresents the quality, price, or performance of their product or service in order to gain an advantage over their competitors in the marketplace. For example, false advertising could involve making false or misleading statements about a product or service on television, radio, or other forms of advertising. Another type of activity that can constitute unfair competition is engaging in activities meant to disrupt or discourage competitors in the marketplace. For example, offering lower prices than competitors’ in order to pull customers from them or spreading false rumors about a competitor’s products or services are examples of activities considered unfair competition. Further, it is considered unfair competition for a business to use another company’s trademark, logo, or other intellectual property without their permission. This includes using a company’s logo, slogan, or other intellectual property in order to deceive or confuse consumers. Finally, forming a cartel, or a group of businesses in a given industry that work together to limit competition has been found to be an unfair competition practice. This is because business cartels typically work together to fix prices, limit output, or reduce competition in a manner that can be detrimental to consumers.
