What is a noncompete agreement and how does it relate to unfair competition law?

A noncompete agreement is a legal contract between two parties that prevents one of the parties from competing with the other in a certain geographic area and/or within a certain period of time. This type of agreement is often used in business relationships, such as when an employer hires a new employee. In North Carolina, these agreements are governed by unfair competition laws. The purpose of unfair competition laws in North Carolina is to protect employers and other businesses from unfair competition. By preventing businesses from competing unfairly with one another, the laws create a level playing field and encourage fair competition. These laws also protect businesses from employees or former employees who may attempt to use confidential information they obtained while working for the business to start a competing enterprise. This is where noncompete agreements come into play. Noncompete agreements are used to protect employers by preventing an employee from competing with the business in the future, even after the employment relationship has ended. The noncompete agreement will outline the geographic area and time period during which the employee cannot compete with the business. It also often contains additional restrictions on the employee, such as prohibiting the employee from recruiting other employees away or using the business’s confidential information. Noncompete agreements are therefore an important part of North Carolina’s unfair competition laws. The agreements allow employers to protect their businesses from unfair competition, and they give employees protection and assurance that they will not have to compete against their former employer.
