What are the elements of a civil conspiracy claim?

A civil conspiracy claim is a legal remedy available to those who have been harmed by an unfair competitive practice. In South Carolina, a civil conspiracy claim has four elements that must be proven in order for the claim to be successful. First, two or more individuals must be involved in an agreement to commit an act that is unlawful or outside the scope of their authority. The agreement must have been entered into with the intention to accomplish an unlawful purpose or to commit a tortious act. Second, it must be shown that the individuals involved in the agreement caused injury or damages to the plaintiff, such as financial losses or infringement of rights such as copyright or trademark. Third, the plaintiff must demonstrate that the individuals involved in the agreement acted with a common purpose, common plan, or common design. Fourth, the plaintiff must demonstrate that they suffered a direct injury or damages because of the actions of the individuals involved in the agreement. The plaintiff must show that the actions of the individuals caused them loss or harm. In addition to these four elements, a plaintiff must also demonstrate that the defendants’ actions were intentional and malicious. The court will consider the amount of damages awarded based on the degree of culpability of each defendant. If a plaintiff is able to prove all of these elements, they will be entitled to recover damages. These damages may include compensatory damages, such as lost profits, and punitive damages as well as attorney fees and court costs.
