What is a Uniform Dispute Resolution Policy (UDRP) claim?

A Uniform Dispute Resolution Policy (UDRP) claim is a type of legal action that can be taken when a business or individual believes another business is engaging in unfair competition. This type of claim is typically used in California when one business believes another business is attempting to damage their name or reputation. The UDRP process is typically initiated with a complaint being filed with the World Intellectual Property Organization (WIPO) online Arbitration and Mediation Center. This complaint then goes through a review process to determine if it meets the legal standard for a UDRP claim. If a complaint does meet the legal standard for a UDRP claim, the case will then be heard by an appointed panel of experts. These experts will review all evidence gathered by the complainant and make an informed decision as to the outcome of the case. If the UDRP claim is successful, the panel can issue one of three remedies. The first remedy may be to have the offending website or business be taken down or have the content removed. The second remedy may be to transfer the domain name of the offending website to the complainant or, finally, the panel may order that the offending party cease and desist any further activities as stipulated in the UDRP claim.
