How has the Supreme Court interpreted the establishment of religion clauses?
The Virginia Supreme Court has been tasked with interpreting the Establishment of Religion Clauses in the Virginia Constitution. The First Amendment to the United States Constitution states that Congress "shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." The language in the Virginia Constitution is similar but has been construed differently in certain cases. In the 2006 case of Governor v. Loudoun County Board of Supervisors, the Virginia Supreme Court interpreted the Establishment Clause as providing protection to individuals and religious practices from government interference and coercion. The Court declared that the Establishment Clause "prohibits government action designed to sponsor, favor, or lend support to any particular religion or religious belief." In interpreting the Free Exercise Clause, the Virginia Supreme Court has long held that the government must generally allow individuals the freedom to practice their chosen religion without interference. In the 1985 case, Ray v. County of Hanover, the Court ruled that a school board could not force students to attend Bible classes against their will. The Virginia Supreme Court has also gone to great lengths to protect individuals from government interference in matters of conscience. In the 2005 case of Shreya v. City of Richmond, the Court ruled that a public radio station could not deny a woman employment based on her religious practices. Essentially, the Virginia Supreme Court has interpreted the Establishment and Free Exercise Clauses of the Virginia Constitution as protecting individuals from government interference or coercion in matters of faith. The Court also has a long history of protecting the rights of individuals to practice their chosen religion without government interference.
