How do I appeal a VA decision?
If you are unhappy with a VA decision and would like to appeal it, you must first file a Notice of Disagreement (NOD) with the VA. The NOD must explain why you disagree with the VA’s decision and should include any relevant facts, evidence, or testimony that support your position. The VA will then review your claim and issue a Statement of the Case (SOC) that discusses the reasons justifying the VA’s original decision. You can either accept the VA’s decision or appeal the SOC by filing a VA Form 9 with the Board of Veteransʼ Appeals (BVA) within a year of receiving the SOC. The BVA will review your claim again and issue a new decision. You can then accept the BVA’s decision or appeal it again by filing a Petition for Review with the U.S. Court of Appeals for Veterans Claims (CAVC). Finally, you can appeal the CAVC’s decision by filing a petition for a writ of certiorari with the U.S. Supreme Court. However, the Supreme Court rarely hears these types of cases. It’s important to note that each step of the appeals process has specific deadlines and forms that must be completed in order to preserve your right to appeal. If you miss any of these deadlines, you may not be able to appeal the VA’s decision. It’s therefore important to seek legal advice before attempting to appeal any VA decision.
