How do I appeal a VA decision?

If you disagree with a decision made by the VA, you have the right to appeal. In Washington, there are two ways to appeal a VA decision: filing a Notice of Disagreement (NOD) or filing a Supplemental Claim. Filing a Notice of Disagreement is the first step to appealing a VA decision. An NOD can come from the veteran or a representative. When the NOD is received, the VA must respond with a Statement of the Case (SOC) that will explain why the VA made the decision. For the Supplemental Claim, you must submit additional evidence to support your appeal. You may need to include your medical records, expert opinions about your condition, or evidence of a service-related injury or illness. If the VA does not provide a response, or the response is unsatisfactory, then you can file a Notice of Appeal. The Notice of Appeal is where you outline the arguments you have for why you should receive the benefits you applied for, and why the VA should reverse their decision. The VA must then respond in writing with a decision, or they may request a hearing with the Board of Veterans Appeals. No matter what your issue is, you have the right to appeal a VA decision if you disagree with it. It is important to understand the process and provide the correct documentation and evidence to support your claim.
