What is a waiver of overpayment?
A waiver of overpayment is a form of relief from the Department of Veterans Affairs (VA) if you are being charged for an overpayment of Veterans Disability benefits in California. The VA will send a letter of notification if you are responsible for an overpayment and you must provide proof of why you should not be responsible for the debt. A waiver of overpayment is an agreement that the VA will waive the debt on their end. This means that the VA will no longer attempt to collect the debt and it will stay off your credit report. It is important to note that the debt can still be reported to the IRS, however, and you may be required to pay taxes on the forgiven amount. In order to be eligible for a waiver of overpayment, you must be able to show that you acted in good faith and relied on incorrect information from the VA when taking the benefits you were overpaid. You must also demonstrate that it would cause financial hardship for you to repay the money. In some cases, this includes showing that paying back the debt would significantly reduce your ability to pay for basic living expenses. The waiver of overpayment helps relieve the veterans from the financial stress of taking on debt from a VA mistake. It is important to understand that the VA does not always grant a waiver of overpayment and will review each situation on a case-by-case basis. If the waiver is approved, the debt will be erased and you will not owe the VA any money.
