What is a waiver of overpayment?
A waiver of overpayment is a legal request that asks for the dismissal of a debt owed by a veteran as a result of receiving too much of a benefit from the federal or state government that was provided for their disability. This waiver is available in Virginia, and applies to veterans who received a disability benefit which ended up being higher than it was supposed to be. This overpayment could be the result of a mistake in calculations or an error in processing the claim. In order to apply for a waiver of overpayment, the veteran must fill out a form and send it to the Virginia Department of Veterans Services. The form must include information about the veteran’s disability, the amount of the overpayment, and the reason for the overpayment. After submitting the form, the veteran will be notified as to whether or not their waiver was approved. If the waiver is approved, the veteran will not have to pay back the overpayment. If the waiver is denied, the veteran will have to pay back the overpayment along with any fees and interest that have accrued. It is important to note that the waiver of overpayment does not eliminate the debt, it simply allows the veteran to avoid having to pay for it.
