What is a presumptive service-connected disability?
A presumptive service-connected disability is a condition that is presumed to have been caused by a veteran’s military service, and is therefore eligible for disability benefits. In California, presumptive service-connected disabilities include conditions related to exposure to certain toxins, such as Agent Orange, as well as certain types of cancers and diseases associated with veterans of certain wars, such as Gulf War Syndrome. It also includes disabilities or conditions that occur due to the aging process, such as cataracts or hearing loss. For a condition to be granted presumptive service-connected status, the veteran must first submit documentation that proves that they were actually exposed to certain toxins or were present in a particular battle or area in the Gulf War. They also must typically provide evidence that proves that the condition was not present before they joined the military. Receiving presumptive service-connected status is important to veterans because, once granted, they are eligible for disability benefits without having to prove that their condition or disability was due to their military service. If, however, the veteran thinks that their disability is due to a service-related injury, they can still submit evidence to prove that they should be given service-connected status.
