What is the Fair Labor Standards Act (FLSA)?

The Fair Labor Standards Act (FLSA) is a federal law of the United States that establishes minimum wages, overtime pay, record-keeping, and child labor standards for full-time and part-time workers in both the public and private sectors. The FLSA was originally passed in 1938 and has since been amended several times. The FLSA applies to most employers in Louisiana, regardless of size. To be covered by the FLSA, an employee must either be engaged in interstate commerce, or an employee of a company with sales or services totaling more than $500,000. Under the law, Louisiana employers must pay employees a minimum of $7.25 per hour and overtime for any hours worked over 40 in a week. A workweek is defined as seven consecutive days and employees must be paid time-and-a-half of their regular rate for any overtime. The FLSA also requires employers to keep records such as time sheets, payroll records, and wages paid. The FLSA also regulates child labor. In most cases, employers are not allowed to employ children under the age of 16. Children under the age of 18 may only do certain jobs or work certain hours, depending on their age. The FLSA ensures that workers in Louisiana are paid fairly and that child labor laws are followed, helping to protect both employees and employers from unfair practices.
