What are the differences between regular pay and overtime pay?
Regular pay and overtime pay are two different types of wages, and the differences between the two are important to understand in New Mexico. Under Wage and Hour Law, regular pay is the rate of pay designated by the employer to be paid to the employee for all hours worked, up to 40 hours per week. Regular pay is usually the hourly rate that the employee receives. Overtime pay, however, is the rate of pay designated by the employer to be paid to the employee for any hours worked over 40 hours a week. Under Wage and Hour Law, overtime pay must be at least one-and-a-half times the employee’s regular rate. This means that if the employee’s regular rate of pay is $10.00 an hour, the employer must pay the employee overtime pay of at least $15.00 an hour for any hours worked over 40 a week. In New Mexico, an employer must pay employees their regular rate of pay for all hours up to 40 hours a week, and overtime pay for any hours worked over 40 a week.
