What are the requirements for meal and rest periods?
In Mississippi, employers are required to provide employees with meal and rest periods, although there are no specific laws that address this. However, employers should adhere to the Fair Labor Standards Act (FLSA) and the Mississippi Minimum Wage Law (MMLW). Under the FLSA, employers must provide employees working shifts of more than six hours with an unpaid meal break of at least 30 minutes. For employees working shifts of more than eight hours, employers must provide an additional unpaid meal break of at least 30 minutes. When it comes to rest periods, employers must provide employees with a 10-minute break for every four hours worked. Employees must be allowed to use the time for whatever they choose, and employers must not require them to perform any work during the break. In addition to these laws, employers should also consider providing their employees with paid breaks throughout the day and should also ensure that any meal or rest periods provided are not interrupted. For example, if an employee must answer the phone during a meal break, the employer should ensure that the employee is compensated for the time.
