What are the rules regarding meal and rest breaks?
In Arizona, employers must abide by the Federal Wage and Hour Law when considering meal and rest breaks for their employees. This law states that employers are not required to provide meal or rest breaks to employees, but they must compensate the employee if they do provide them. For employees who are over eighteen years old and work more than 5 hours in a day, employers must provide a minimum 30-minute rest break. This break must be unpaid, meaning that the employer does not have to pay the employee for the time taken for the break. If the employee works for more than nine hours in a day, then the employer must provide an additional 30-minute unpaid rest break. For employees who work 10 or more hours in a day, the employer must provide a 60-minute unpaid meal break. Employers have the option to provide breaks of shorter duration, such as a 15-minute rest break, but they are still expected to provide a total of 30 minutes for rest and 60 minutes for meal breaks. If employers don’t comply with these regulations, they can be subject to fines and penalties imposed by the Department of Labor.
