Are employers required to provide employees with work breaks?
In Colorado, employers are required to provide their employees with work breaks under wage and hour law. Generally speaking, employers in Colorado are required to provide a 10-minute break for every four hours of work. This break must be given to employees during their regular shift and should not be combined with the employee’s lunch or other mealtime. In addition, the Colorado Wage and Hour Law requires employers to provide a rest period of at least 30 minutes for shifts lasting longer than 5 hours. However, this rest period does not have to be paid and employers can decide whether or not to give their employees this time for rest. Generally, employers are required to allow eligible employees the opportunity to take a 30-minute meal break for every five hours worked. Meal breaks do not have to be paid, however, the employer must provide a suitable place for employees to take their meal breaks. Also, during meal breaks, employers are not allowed to require their employees to perform any type of work.
