What are the requirements for providing paid time off?
In Pennsylvania, employers are required to provide paid time off for certain situations. All employers must provide paid time off for jury duty, voting, and military leave. Additionally, federal law requires employers to provide unpaid time off if an employee needs to take care of illness and/or injury, the birth or adoption of a child, and family military leave. Employers must also provide paid leave for religious holidays as long as they are part of the same religion practiced by at least 15% of the employees in the company. Employers must also provide up to 12 weeks of unpaid leave for employees who need to take time off for certain family and medical reasons, such as caring for a newborn child or caring for an immediate family member with a serious health condition, under the federal Family and Medical Leave Act (FMLA). Finally, employers may also provide paid time off as part of an employee benefits package, including vacation, sick, and personal days. Employers are not required to provide this type of leave, but if they do, they must comply with any applicable laws.
