When can employers legally ask employees to work off the clock?

In Colorado, employers are not allowed to ask employees to work off the clock. Under wage and hour laws, employers must pay workers for all hours worked, and cannot require them to work “off the clock” without pay. Generally, employers cannot require an employee to complete any tasks before or after their shift, even if those tasks are related to their job duties. In addition, employers must pay at least the minimum wage for all hours worked, as set out by the state. Under Colorado law, employers must compensate employees for all overtime hours worked within seven days of the end of a pay period. Furthermore, employers cannot pay employees in goods instead of money, or promise to make future payments for hours worked. It is important to note that employees can volunteer to work without pay if it is done on their own free will and with the knowledge and approval of their employer. In Colorado, employers must also make sure that their employees are not working more than 12 hours in a single day. Any hours over 12 must be paid at an overtime rate as required by law. Finally, employers in Colorado must keep accurate records of their employees’ work hours and wages and cannot ask employees to falsify their time worked. Doing so is illegal and can result in hefty fines and even criminal penalties for the employer.
