What are the rules for paying employees for work-related travel?

In Colorado, employers are required to pay their employees for any time spent traveling for work-related purposes. This includes all the time it takes to travel to and from a client’s office, job site, or other business location. It also includes the time spent waiting for a job or other work-related activity to begin. Employers must pay for time spent traveling at the employee’s regular hourly wage rate, regardless of the distance traveled. In addition, any expenses incurred during travel, such as meals, lodging, and transportation costs, must be reimbursed to the employee. The employee should submit all receipts for reimbursement. The employer is required to reimburse the employee the actual expense or the amount allowed by standard IRS regulations, whichever is less. If employees are required to work while traveling, such as when they are driving to a job site, they must be paid for all time spent in transit. All hours worked must be reported and paid at the employee’s regular hourly wage rate. This includes overtime hours worked on any travel day that exceeds the employee’s regular work hours for the day. Employers must also adhere to the Colorado Minimum Wage Order, which requires that employees be paid at least the minimum wage for all hours worked. All time spent traveling for work-related purposes must be taken into consideration when calculating employees’ wages. Failure to comply with wage and hour laws can result in fines and other legal penalties.
