Are employers required to pay double time for work on holidays?
In Mississippi, the state generally follows the Fair Labor Standards Act (FLSA) regarding wage and hour laws. The FLSA does not require employers to pay double time for work on holidays. However, it does require employers to pay overtime for hours worked over 40 in a workweek, which may include time worked on holidays. Under the FLSA, employers in Mississippi are required to pay their employees one-and-a-half times their regular rate of pay for all hours worked over 40 in a single workweek. This includes time worked on holidays. For example, if an employer pays an employee an hourly wage of $10 and they work on a holiday and get 45 hours of pay, the employee would receive 10 hours of regular pay, and 35 hours of pay at the rate of one-and-a-half times their regular rate of pay, which would be 15 dollars an hour. So, while employers in Mississippi are not required to pay double time for work on holidays, they are required to pay one-and-a-half times the employee’s regular rate of pay for all hours worked over 40 in a single workweek, including time worked on holidays. Employees should review their own employment agreements to determine if they are eligible for any additional pay or benefits for work on holidays.
