What is the overtime rate for hourly employees?
In Mississippi, employees who are entitled to receive overtime pay must receive an overtime rate of one and one-half times their regular rate of pay for any hours they work over 40 in a workweek. All non-exempt employees in Mississippi must receive overtime pay, regardless of the type of work they perform. In Mississippi, the governing law for overtime pay is the Fair Labor Standards Act (FLSA). The FLSA requires employers to pay their non-exempt employees overtime pay at one and one-half times their regular rate of pay for all hours in excess of 40 hours in a workweek. The FLSA does not require overtime pay for hours worked over eight in a day. In Mississippi, the minimum wage for non-exempt employees is $7.25 per hour. Therefore, the overtime rate for non-exempt employees in Mississippi would be one and one-half times $7.25, or $10.88 per hour. Any hours worked over 40 in a workweek must be paid at this rate. Some employees, such as those who work in the hospitality industry, may have an amended overtime rate. Additionally, employees who make a salary may have a different overtime rate or may not be entitled to overtime pay. It is important for employers to familiarize themselves with the overtime laws in Mississippi and to ensure they are compliant with all wage and hour requirements.
