What are the differences between compensatory time and paid time off?

Compensatory time and paid time off are two different categories of benefits provided to employees in Mississippi under wage and hour law. Compensatory time, often referred to as “comp time,” is time off that is given to employees in lieu of overtime pay when they work extra hours. Comp time must be given in the same hour for hour ratio as the extra hours worked. For example, if an employee works 4 extra hours, they must receive 4 hours of comp time off. However, comp time can only be given if both the employer and employee agree to it before the extra hours are worked. Paid time off, on the other hand, is time away from work that is paid. This typically includes holidays, vacation days, personal days, sick days, etc. The amount of paid time off that an employee will receive is determined by the employer. In Mississippi, state law does not specify minimum amounts of paid time off that employers must provide. In summary, the main difference between compensatory time and paid time off is that compensatory time is time off given in lieu of overtime pay, while paid time off is time away from work that is already paid for.
