What are some of the financial incentives available to whistleblowers?

In California, whistleblowers are eligible for financial incentives as provided under the False Claims Act and/or other statutes. The False Claims Act encourages individuals to come forward and report fraud against the government by allowing whistleblowers to receive a percentage of the government’s recovery as an award. If the government successfully recovers money from the individual or entity that committed the fraud, the whistleblower is eligible to receive up to 30% of the total recovery. The whistleblower may also receive incentives that are provided through other statutes such as the IRS Whistleblower Program, SEC Whistleblower Program, and the CFTC Whistleblower Program. Under these programs, whistleblowers can receive rewards of up to 30 percent of the amount successfully recovered by the government. In addition to monetary rewards, whistleblowers may also be eligible for other types of financial incentives. These include protection from job retaliation, reimbursement of legal fees, and additional compensation to make up for lost wages or other losses resulting from the whistleblower’s actions. Under California law, anyone who brings a successful claim is also eligible for attorney’s fees and costs, and may be able to pursue other types of relief such as reasonable costs incurred with respect to the case. Furthermore, those who file a claim with reasonable grounds to believe that the claim is valid may be awarded civil fines and penalties. Overall, whistleblowers in California who come forward and provide evidence of fraud or abuse against the government are eligible for a number of financial incentives. These include a share of the government’s recovery, as well as reimbursement of attorney’s fees, protection from job retaliation, and additional compensation for any losses incurred due to the whistleblowing activity.
