What is the Defend Trade Secrets Act of 2016?
The Defend Trade Secrets Act of 2016 is a federal law that provides legal remedies for trade secret misappropriation. It was added to the Economic Espionage Act of 1996 and is applicable to all states in the United States, including Florida. The Defend Trade Secrets Act of 2016 provides federal civil remedies for misappropriation of trade secrets related to products and services used in interstate and foreign commerce. Under the Act, trade secrets are defined as all forms of financial, business, scientific, technical, economic, or engineering information, including patterns, plans, compilations, program devices, formulas, designs, prototypes, methods, techniques, processes, procedures, programs, or codes. The purpose of the Defend Trade Secrets Act is to provide a uniform standard for trade secret protection. This helps to ensure that businesses and individuals in Florida are able to protect their trade secrets and intellectual property. The Act also makes it easier for businesses to access legal remedies for trade secret theft or misappropriation. The Act gives trade secret owners the ability to seek court orders, including injunctions, to prevent or stop further misappropriation of trade secrets. They may also be able to recover damages including actual loss, unjust enrichment, and a reasonable royalty. Additionally, the Act provides for attorneys’ fees to be awarded in cases where a trade secret has been misappropriated by another party.
