What is a workers' compensation hearing?

A workers’ compensation hearing is a formal legal proceeding intended to resolve disputes between an injured worker and an employer or its employer’s insurance company. The hearing is held in front of an administrative law judge and is designed to decide questions such as whether benefits should be provided to the worker, how much the worker should receive, what kind of medical treatment should be provided, and whether the worker is eligible for other benefits. The hearing process begins when the worker or their representative files a petition with the Virginia Workers’ Compensation Commission. The petition must set forth the reasons why the worker believes they are entitled to benefits. The employer or insurance company can then respond by filing an answer or any other objections. Once the petition and answer or other objections are filed, a claimant’s hearing is scheduled. This hearing is like a trial before a judge. The parties present evidence and argument in support of their positions. The administrative law judge then rules on the matter, deciding if benefits should be awarded, how much the worker should receive, and what other remedies the worker may be eligible for. The judge’s decision can be appealed by either party, but the final decision is typically binding. Therefore, it is important to be prepared and well represented at a workers’ compensation hearing in order to ensure that the worker’s rights and best interests are fully represented and that a fair outcome is reached.
