Are workers' compensation benefits taxable?

In California, workers’ compensation benefits are generally not taxed. This is because most workers’ compensation payments are considered injury-related and are therefore not taxed as income. However, there are certain circumstances where some or all of a worker’s compensation benefits may become taxable. For instance, if the employee’s injury was caused by intentional behavior or insubordination, any payments received for lost wages may be taxable. Any settlement payments, such as punitive damages, may also be taxable. Additionally, if the employee is receiving disability payments, these may be taxable if the employee is also receiving Social Security disability benefits. In this case, any workers’ compensation payments received would be added to the employee’s taxable income for the year. Finally, any payments for vocational rehabilitation may also be considered taxable income. Any medical expenses reimbursed by workers’ compensation may also be taxable if the employee chooses to itemize deductions. In summary, most workers’ compensation benefits are not taxable in California. However, there are some cases where some or all of the benefits may be considered taxable income. Therefore, it is important to check with your accountant or tax adviser before filing taxes to make sure you are aware of any potential tax implications.
