What is a permanent disability?
A permanent disability is an injury or illness that affects an individual’s physical and/or mental abilities and results in a long-term loss of function. In Washington, these disabilities are recognized as an occupational injury or illness under workers’ compensation law. A person may be classified as having a permanent disability in Washington if their injury or illness is determined to be permanent and stationary or there is a significant impairment of body functions. The individual must have a permanent work restriction and suffered a permanent loss of earning capacity in order to receive a permanent disability rating. In addition, Doctors in Washington can assign a permanent disability rating to the injured worker, which is used to help establish the settlement or award for the worker’s pain and suffering. The rating is based on the doctor’s assessment of the worker’s impairment and can range from 0 (no impairment) to 100 (severe deprivation of use of a body part or organ). For those with a permanent disability, workers’ compensation benefits may include medical treatment, vocational rehabilitation costs, and the potential for a lump-sum settlement. It is important to note that the laws and regulations surrounding permanent disability benefits vary by state, so it is important to consult with a qualified attorney to discuss the specifics of a case and understand the laws in Washington.
