What is the workers' compensation appeals process?

The workers’ compensation appeals process in Washington allows a person to dispute the denial of a workers’ compensation claim. When a worker is injured on the job, they can file a claim for benefits with the Department of Labor and Industries. If the claim is denied due to insufficient evidence or missing eligibility requirements, a worker may appeal the decision. The appeals process begins with filing a written request with the Board of Industrial Insurance Appeals. The request must explain why the claim was wrongfully denied and why the injured worker believes the claim should be accepted. The Board will then review the appeal and make a decision. If the Board denies the appeal, the worker can then file a reconsideration request. The worker must provide additional evidence or reasons why the claim should be accepted. After considering the request, the Board will issue a decision. If the worker is still unsatisfied with the outcome, they can file an appeal with the Washington State Court of Appeals. The employee must provide new evidence or arguments that support their claim. The Court of Appeals will make a decision based on the arguments provided. If the Court of Appeals denies the claim, the worker may appeal the decision to the Washington State Supreme Court, but the Supreme Court will only consider the case if the ruling of the Court of Appeals was erroneous or contrary to law.
