What is the difference between wrongful termination and constructive dismissal?

Wrongful termination and constructive dismissal are two different types of employee termination. Wrongful termination is when an employee is fired without justification or in violation of a contract. A wrongful termination can also occur when an employee is fired in violation of a public policy or if the termination is motivated by discrimination or harassment. On the other hand, constructive dismissal is when an employer creates a work environment that is so hostile or oppressive that it essentially forces the employee to resign. This includes situations such as reducing an employee’s pay or benefits, transferring the employee to a location that is far from home, or changing terms of employment without the employee’s consent. In California, wrongful termination is illegal. An employee who has been wrongfully terminated can seek damages, including lost wages and benefits, court costs, and emotional distress. Employers can be held liable for wrongful termination if they did not have a good faith reason for terminating their employee. Constructive dismissal is also illegal in California. Employees can seek damages in cases of constructive dismissal if they can prove that their employer created a hostile work environment.
