What is the difference between wrongful termination and wrongful abstinence?

Wrongful termination and wrongful abstinence are two different types of wrongful employment practices. Wrongful termination is when an employee is fired without cause, or for an illegal reason such as discrimination. Wrongful abstinence is when an employer refuses to hire or promote someone based on their race, creed, color, national origin, gender, sexual orientation, or other protected characteristic. Wrongful termination usually involves an abrupt and permanent separation between the employer and the employee. In Maryland, employers are prohibited from firing someone based on any of the protected categories listed above. They are also prohibited from firing someone for a reason that is contrary to public policy. If an employee believes they have been wrongfully terminated, they may pursue a wrongful termination claim through the court system. Wrongful abstinence is when an employer refuses to hire, promote, or otherwise benefit someone based on their protected status. This can include refusing to hire someone because of their race, refusing to promote someone because of their gender, or refusing to pay a woman a higher wage than a man. Wrongful abstinence can also involve refusing to promote or assign a job to someone based on their religion or sexual orientation. If an individual believes they have been wrongfully abstained from work, they may pursue a wrongful abstinence claim through the court system.
