What is the difference between wrongful termination and retaliatory discharge?
Wrongful termination is when an employee is unlawfully dismissed from their job without any legal justification. This type of termination usually occurs when an employee is fired for discriminatory reasons, such as their race, gender, or religion, and can be considered a form of workplace discrimination. Retaliatory discharge is when an employee is wrongfully dismissed from their job in response to an action taken by that employee. This can occur when an employee makes a complaint against their employer to a governmental body or reports illegal activities engaged in by the employer. It can also happen when an employee refuses to participate in illegal activities carried out by the employer. Retaliatory discharge is often seen as a form of unfair dismissal or wrongful termination. In Arizona, an employee may be protected against wrongful termination under state and federal laws if they are fired for discriminatory reasons. An employee may also have a cause of action for retaliatory discharge under state law if they are wrongfully dismissed for making a complaint or reporting an illegal activity.
