What are the prohibitions for product placement?

Product placement is a form of advertising where a product is mentioned or displayed in a piece of media, such as a film or television show. In California, there are certain regulations that must be followed in order to legally place a product into a piece of media. First, product placement must be disclosed to the audience. This disclosure must be clear and conspicuous and must include the name of the product that was placed and the name of the company that paid for the placement. This disclosure must also be visible during the entire duration of the product placement. Second, product placement must not appear to be an endorsement or recommendation by the producer, director, actor, or any other people involved in the production. Furthermore, it must not be placed in a way that could be confused by viewers as an endorsement. Third, product placement must not be excessive or repetitive. It must be limited to a single product and appear no more than once in a program or advertisement. Finally, product placement must not be used for illegal and/or hazardous activities. This includes the placement of products that are against the law, such as tobacco and alcohol. In order to legally utilize product placement in California, producers and directors must abide by the regulations outlined above. When done correctly, product placement can be a great way to market a product in an entertaining and unobtrusive manner.
