What are the water rights laws in agriculture?

Water rights laws refer to how water is allocated and used in relation to farming. In California, water rights are determined through two different systems: riparian water rights and prior appropriation water rights. Riparian water rights are based on the concept of "first in time, first in right." Under this system, the owners of the land bordering a body of water have the right to the water flowing through their land. This means that if two riparian owners are using the same body of water, the one who first put the water to use has the higher priority. Prior appropriation water rights, also known as the “first in use, first in right” system, refers to the concept that the first person to put the water to beneficial use has a higher priority than someone who did not. This system is most often used for irrigation, and it does not give any inherent rights to the landowner, but does give priority to the first appropriator of the water. In California, water used for agricultural purposes is regulated by both state and federal agencies. The State Water Resources Control Board has the authority to allocate and use water, while the United States Bureau of Reclamation carries out federally funded irrigation projects. Both agencies have the authority to amend and modify existing water rights laws. Overall, water rights laws in California are determined either by the riparian system or the prior appropriation system, and they are regulated by both state and federal agencies. These laws are incredibly important, as they determine how water is shared and used among agricultural producers.
