What are the laws regarding agricultural workers’ rights?
Agricultural workers’ rights in Delaware are largely protected by federal labor laws and individual state labor regulations. The minimum wage in Delaware is set at the federal minimum of $7.25/hour, which applies to agricultural workers as well. Agricultural workers must also be provided meal and rest breaks in accordance with federal and state regulations. In terms of overtime pay, agricultural workers in Delaware are entitled to one and a half times their regular rate of pay for hours worked beyond the 40 hours in a seven day period, and double their regular rate of pay for hours worked in excess of 12 hours in a single day.
