What are the laws governing the use of biotechnology in agriculture?
In Washington, the laws and regulations governing the use of biotechnology in agriculture are found in the Washington State Biotechnology Seed and Plant Regulatory Program. The program was developed to foster and promote the safe and responsible use of biotechnology in plant production and research and to protect the environment and human health. The Program requires all entities that are working with genetically engineered organisms to register with the Washington State Department of Agriculture (WSDA) and to obtain a permit. After registering, the entity must follow certain protocols related to the handling, storage and disposal of the engineered organisms. For example, the organisms must be kept in a secure and adequately labeled container, and any disposal of the material must occur in accordance with state regulations. The Program also requires that all protocols used to create or work with genetically engineered plants must be thoroughly tested and evaluated prior to their use, so as to protect human health and the environment from any potential risks. Additionally, entities using engineered organisms must inform the public about any risks posed by the organisms. The Program also requires that all entities using genetically engineered organisms must comply with applicable federal laws and regulations pertaining to environmental safety, such as the Clean Air and Clean Water Act. In addition, entities must also report any incidents that may have a negative environmental or health impact to the WSDA.
