Is alimony reduced if the payor earns less than the recipient?

In Louisiana, the outcome of an alimony reduction request for a payor earning less than the recipient can vary depending on the specifics of their divorce agreement and court order. Generally, a court may reduce or terminate alimony payments if the payor earns less than the recipient, provided the payor can prove to the court that they are unable to pay the full amount. In general, if the alimony payments provided for in the court order are overly burdensome, there may be an option to reduce the payment amount. The court will consider any changes to the payor’s financial situation, such as involuntary unemployment, disability, or changes in income. If the payor’s financial situation remains substantially the same, the court may deny the reduction. The court will need to hear from both parties in order to make a determination. If the court agrees to reduce alimony, the payor will need to provide full disclosure of their financial information along with a copy of their tax return to prove their current earnings. When determining an alimony reduction request in Louisiana, the court must see if the payor has demonstrated a “change in circumstance”, and if so, will modify the alimony payments accordingly. Alimony payments may be reduced if the payor’s income is substantially less than that of the recipient, but the court will have the final say on if and how much the payments should be reduced.
