Are there any limits on the number of cannabis plants that can be grown?
In Virginia, there are limits on the number of cannabis plants that can be grown. According to the Virginia Medical Cannabis Law, the total number of cannabis plants that can be grown at any one time for medical use cannot exceed an amount that would supply a ninety-day supply for the patient’s medical condition and any other persons with whom the patient has entered into a joint-purchase agreement or who resides with the patient. The maximum number of plants that can be grown is determined by the practitioner, taking into consideration the practitioner’s best medical judgment, the amount of time the patient will take to become stable on a cannabis treatment regimen, and the amount of cannabis that would reasonably be expected to be needed due to the patient’s medical condition. In addition to this, the number of cannabis plants allowed per household is limited to four. It is important to note that no cannabis plant can be grown within 1,000 feet of a school, daycare center, or youth center, with the exception of having an indoor grow facility in a private residence where the plants are not visible from the exterior of the residence or any adjacent public or private property. Virginia also has regulations regarding the types of cannabis that can be grown. Only seeds or plants that are cultivated from seeds are allowed, and the seeds must be purchased from one of the two cannabis testing laboratories in the state. Each seed must be tested to ensure it meets specific quality standards for cannabinoid content. Therefore, while Virginia does allow for some cannabis growth, there are limits and regulations in place to limit the total number of plants that can be grown.
