What rights do I have under the Fair Debt Collection Practices Act?
Under the Fair Debt Collection Practices Act (FDCPA), you have certain rights as a consumer in the state of Rhode Island. This federal law applies to debt collectors and offers protections for individuals with debt. You have the right to dispute the debt and request validation of the debt from the creditor or debt collector. After receiving your dispute, the creditor or collector has to produce evidence that you actually owe the debt. You also have the right to stop collection calls. You can do this by sending a written request to the debt collector telling them to stop contacting you. The debt collector has to stop calling you, except to advise you that there will be no further contact or to notify you that they are taking certain actions against you, such as filing a lawsuit. You have the right to seek damages if the debt collector violates the FDCPA by using unfair practices to try and collect the debt. These violations can include harassing phone calls, false or deceptive statements, or using abusive language. You also have the right to be informed of how the debt collector is using your information. The debt collector has to tell you just how they are using the information you provide them. These are just a few of the rights you have under the Fair Debt Collection Practices Act in Rhode Island.
